Extract from Companies House Representative

Below is the communication we have had with Companies house regarding Website Compliance. 

Dear Kevin  

All the new rules do is extend the existing paper rules to electronic communications and company websites.  What we are telling customers is that if an email is being sent in the place of a paper business letter or any of the communications listed in the regulations then the email would be subject to the same rules as they would if the communication had been sent on paper.    The company name must appear on almost all business communications, but the registered office address, registered number and place of registration must only be on business letters, order forms and the company website.  In this particular case if the email is not a business letter then only the name need appear because it could be classed as an official publication of the company.   These rules are in place to ensure that third parties know with what company they are dealing with when they receive a business letter, invoice etc.. If the email is just sent to members of the club/company, then I would have thought the recipient must surely know who it is from and I can't see anyone complaining that they are getting communications from a company they don't know the identity of.   Hope this helps.   Regards   Ian       Ian Smith

Dear Ian   Thank you for the advice.   The reason for asking is that my company provides web site software to the Sports Industry. And we always like to be proactive in informing our 100 + Clients about regulations etc.   Within our software is an email manager, which is used by my clients to mass mail their members regarding activiities and lastes news at their clubs. These are not business letters, but merely information.   Therefore do these types of email require the mandatory information to be shown on them, as strictly this is an internal matter between members.   I look forward to your clarification   Many thanks   Kevin Evans

Thank you for your mail.   The company name , registered number, place of registration must appear on business letters, order forms and the company website.  There is nothing in the legislation that states where on the website the information must be, or that it must be on every page. Dear Mr Smith   I noticed that there is a new requirement from the 1st Jan regarding the publication of Company details on websites.   Having read the article on Companies House Website, could you clarify for me the following:   Does the publication of Company resgistration number, registration place and registered office have to appear universally on every page of the website, or is this information restricted to forms (either downloadable or otherwise) and business letters.   Yours faithfully   Kevin Evans
